A new determination Social Security (AGDRP-Adversely Affected Persons-Nepal Flash Floods) Determination 2026 (LIN 26/101) has been made on 25 September 2026, specifying who is taken to be adversely affected by the Nepal flash floods for the purposes of the Australian Government Disaster Recovery Payment (AGDRP).
The determination applies to the severe flash flooding in Nepal, including associated landslides and debris flows, occurring on and from 26 August 2026 as a result of a glacier collapse.
A person is taken to be adversely affected if:
- Serious injury: they were seriously injured as a direct result of the disaster, meaning they were admitted to hospital or, under normal circumstances, would have been;
- Family of an Australian citizen or resident: they are an immediate family member of an Australian citizen or resident who is missing and presumed deceased, or deceased, as a direct result of the disaster; or
- Carer: they are the carer of a child who falls within either of the above.
Immediate family member means a partner; a natural, adoptive or step-child; a natural, adoptive or step-parent; a legal guardian; or a brother, sister, step-brother or step-sister.
The determination is repealed on the day after the end of two years from its commencement.
