Impact of Negative Personal Procedural Decisions on Ministerial Intervention Requests

The Department of Home Affairs has issued outcome letters to individuals whose Personal Procedural Decisions (PPD) under section 351 have resulted in a negative determination.

These letters specifically apply to requests lodged before 12 April 2023 that have not been subject to a personal procedural decision or a substantive public interest decision by a Minister.

Important Information Regarding the Outcome Letters:

  • Finalised Requests: The letters inform applicants that their requests impacted by a negative personal procedural decision are now finalised.
  • Option to Lodge a New Request: Applicants are advised that they may submit a new request for Ministerial Intervention if they meet the criteria outlined in section 13 of the new Ministerial Intervention Guidelines.
  • Not a “Relevant Earlier Request”: It is important to note that the earlier request will not be treated as a “relevant earlier request”, meaning a new request must be lodged if the applicant wishes to pursue the matter again.
  • Eligibility Not Confirmed: The letter does not state that the applicant satisfies the criteria for a new request. It simply informs them of the option to lodge a new request, provided they meet the necessary requirements.
