The new Access to Movement Records Instrument 2025, effective 23 September 2025, modernises access provisions and replaces the 2024 version.

This update ensures the continued clarity and compliance around authorised access to movement records across Commonwealth, State, and Territory jurisdictions.

Key Provisions:

  • Specifies the prescribed Commonwealth, State, and Territory legislation under which officers may be authorised to access movement records, in accordance with subregulation 3.10A(1) of the Migration Regulations 1994.
  • Details the prescribed agencies and employees of the Commonwealth, a State, or Territory, as outlined in paragraphs 3.10A(2)(a) and (b) of the Migration Regulations, and the specific purposes for which these employees may access movement records pursuant to paragraph 3.10A(2)(c)
  • Reflects recent changes in agency names and structures to maintain accuracy.
  • Removes references to repealed legislation
